Daniella's Track Side Grille Owed $40K in Sales Taxes

The popular Fair Lawn restaurant and bar has been closed since Oct. 11 with an orange state seizure notice taped to its front door.

Daniella's Track Side Grille, a Fair Lawn staple that has remained closed since being seized by the state last week, owed $40,000 in sales taxes, a Treasury Office spokesman confirmed.

Andrew Pratt, the state Treasury Department's communications director, said the Division of Taxation had been working with the restaurant since 2010 to collect the unpaid taxes, but ultimately gave up hope and closed it down last Thursday.

"We've attempted to work with them, to collect taxes and help them in those areas wherever we could, but despite our efforts they just weren't paying taxes," Pratt said. "When someone repeatedly doesn't follow the law, there has to be some penalty eventually. You can't go forever."

In New Jersey, businesses are required to charge a 7 percent sales tax on customer purchases and pass that money on to the state. They aren't legally permitted to touch the sales taxes they collect or divert them to another use.

Pratt said that more than 99 percent of the restaurant's unpaid taxes were sales taxes and less than 1 percent were payroll taxes.

Daniella's won't be re-opening unless the restaurant pays back all the taxes owed, enters an agreement to pay taxes going forward and demonstrates it can actually pay those taxes, Pratt said.

Joanne Graziano, the restaurant's manager, previously said the restaurant's stakeholders "were working on a solution," to pay the back taxes and re-open. 

They may also sell the restaurant, if a buyer can be found. Track Side has been on the market since early 2010. Its asking price, which was originally $1 million, is down to $599,900, according to the New Jersey Multiple Listing Service

Closing the restaurant down seems heavy-handed and a lose-lose for everyone. I would favor working with a business thru a recession....and then giving the governor a foot-long sandwich to-go and another "free" copter ride to Teterboro his next out-of-state campaign stop to raise $$$ for his buddies.

The Governor claims he for business.....creating jobs?? Yet the state shuts down a well established restaurant??!! Chrispy likes to hear himself talk...Egotistical Fat Millionaire..... Unemployment almost HIGHEST in NATION...and people like this guy basically because of his LOUD mouth....I don't get it...and my homeowners taxes went up again!! He gets to ride in free helicopters... while middle class Joe has to suffer... So yes the governor is part of the problem here...... If I spoke to people in my business like he speaks - I would be out of business!! He should be out of business....

Albeit there will now be more unemployment in town... 1) it would have happened anyway, the place went way downhill and the place is nearly empty all of the time 2) We all need to pay our taxes, as Mei pointed out.. Collecting state tax and pocketing it is stealing!! They are just lucky (for now) that a shutdown was all that happened, this could be a criminal offense!! 3) Why dont you pay their tax bill? if you care so much about local jobs being lost and all??? Whats that... radio silence???

Hahaha...thats amusing... This Fat Governor promised to lower my 12K tax bill.... its still going up..... Crime is rising around us......He vetoed the millionaire tax...2 times.... Travels across the country on our TAX money to do political favors for himself.... Takes free helicopter rides to his son's baseball game..... And then yells at honored serviceman at town meetings (Navy Seal) because he brings up an opposing viewpoint...Oh.. and UNEMPLOYMENT is at a 50 year HIGH IN NEW JERSEY!! I love NJ....grew up here...but soon to retire and will leave this state to a place where I can just laugh at the FAT man and his antics.... Bully mobster wanna be - How he is able to get away with his filty mout is disgraceful...."taking a BAT" to an elder female politician?? I mean who says that? Talks about public officials cutting costs...furloughs...cuts in pay and medical plans.... while his fat butt flys in helicopters and private jets to do speeches??!! I mean really??!! I don't care for Christy's hectoring ways and wierd math myself, but in the interests of accuracy, I have to point out that overall crime rates in NJ and even in Fair Lawn has been steadily decreasing since at least 2006. (This reflects an national trend, though of course it's no comfort to those people who *are* victims of crimes.)

That $40,000 in unpaid taxes represents $572,000 in receipts - I would bet almost a years worth for the restuarant. Why was it allowed to get to that point before some action was taken, and why was the action taken to close it entirely and cut off any chance it might have some cash flow to pay off the debt? There's more to this story than simply not paying taxes - either they defaulted on a payment plan or refused to try to work out a settlement entirely. Been a bookkeeper enought years and seen enough dealing with the NJ Dept of Taxation to not get a sense that there is more to this story than appears here.

@Deleted - Daniella's had been on a payment plan since 2010 and it wasn't working out, according to the treasury spokesman. I don't know the specifics of the plan, but the Division of Taxation ultimately gave up because they weren't receiving the payments. Apparently after two years they felt enough was enough and closed them down.

He rides helicopters to his SOns baseball games!!! He uses tax payer money to do speeches for a presidential candidate!!! Hotels, State Police, all paid for by us!! traeted a NAVY SEAL like dirt at a town meeting.(war hero) no less....and is a BULLY to those who have a different view point....wat is not to believe?? Jenne - I wish I could agree with you.....State cuts by the governor Chrispy forced the layoffs of over 100 police officers in Paterson...... Check out their homicide rate this year and gang related shootings....... Camden had to close down their polce department due to state cuts.... and give Newark a call and ask a cop if crime has gone down..... Laid off a third of the department...carjackings, homicides...shootings all UP!! but remember the millionaires dont ride through those nasty cities....so who cares about them.....Its their own fault attitude..thats Gov Chrispy at his best....

You are the problem with NJ, you blindly follow politics like its a football game. Unless if you bet on it, the outcome is of little consequence. Politics is different, it impacts everyone's lives. Your issue with Christie is not his size, but his party. If he were a democrat with the same results he'd be the best thing since slice bread. Zak: that was my suspicion. Usually, if they show intent, even if they ask for reduced payments, there will be some effort on the state's part to give them a chance. That they closed the business and cut off the cash flow probably says everything. I've worked for small companies that had sudden cashflow issues that caused them to miss payments, and never found the NJ tax office to be unreasonable - after all, they'd rather make interest and penalties and get paid than get nothing and have to stand in line with the other creditors for what's left at the end.

(HIGHER THAN NATIONAL AVG) ..People are angry so they like this "bully" mentality now because he claims he will cut the waste... Then he has nerve to go on free helicopter rides.....and make political trips while the state unemployment continues to rise.... If you cant see through this guy YOUR head is buried in the sand... I'm an independent...not tied to a political party.... The crime rate in NJ cities is incredibly high under his cuts.... Please give me one thing that is better?? beside him being a bully to the state workers.. He is in for himself.......not for the common people of the state...
