Embattled Police Captain Reaches Retirement Agreement with Borough

Fair Lawn police Capt. Joseph Cook, the target of multiple lawsuits and a 2012 internal affairs investigation, has retired, effective Thursday.

Fair Lawn police Capt. Joseph Cook, who faced administrative charges stemming from an internal affairs investigation last year, retired Thursday rather than fight the matter before the Office of Administrative Law in Newark, his attorney Patrick Toscano said. The borough placed Cook on paid administrative leave last June and brought administrative charges against him in early July. At the time, Toscano said Cook was given two options upon his return to the department: accept a demotion to Lieutenant or take a suspension. Cook, who maintains his innocence, returned to his previous job within the department following the investigation. Police Captain Cleared of Evidence Shredding Allegations

In November, the attorney for a police lieutenant who brought suit against Captain Joseph Cook had alleged that Cook and an administrative assistant were destroying documents related to the lawsuit.

The borough has cleared Capt. Joseph Cook of allegations that he destroyed evidence pertaining to a lawsuit filed against him by a police lieutenant, his attorney Patrick Toscano confirmed Thursday. The attorney for Lt. Bob Kneer, whose suit alleges that Cook and Police Chief Erik Rose created a hostile work environment in an attempt to compel him to retire, sent a letter to the borough's municipal excess liability attorney last November alleging that Cook and an administrative assistant within the police department were shredding documents related to the lawsuit, NorthJersey.com reported in March. Police Captain to Fight Disciplinary Charges in Court

Following an internal affairs investigation, the borough has brought administrative charges against Capt. Joseph Cook, his attorney said.

Fair Lawn Police Capt. Joseph Cook, whose conduct was the subject of a recent internal affairs investigation, will fight the administrative charges brought against him by the borough and seek a hearing before the Office of Administrative Law in Newark, his attorney Patrick Toscano said. “Captain Cook is a terrific law enforcement officer, who has served the residents of Fair Lawn with distinction and dedication for almost 3 decades,” Toscano, whose Caldwell-based firm specializes in law enforcement defense work, wrote in an email. “He has done absolutely nothing violative of any rule or regulation at any time.” Borough officials declined to say what provoked the investigation into Cook, but have confirmed that he was out of the office on …
